DELIVERY POLICY

This Delivery Policy applies to all purchases made through ikuista.com.

By placing an order, the Customer agrees to the terms set out below.

Nothing in this policy limits statutory consumer rights under applicable EU law.


1. Delivery Area

IKUISTA products are shipped from our registered facility in Finland.

Delivery is available within the European Union and the European Economic Area unless otherwise stated at checkout.

We reserve the right to refuse or cancel orders placed for delivery outside our stated delivery area.


2. Delivery Times

Estimated delivery times are displayed at checkout and in the order confirmation.

All delivery times are estimates only and are not binding deadlines unless explicitly agreed in writing.

IKUISTA bicycles are individually manufactured and assembled after order confirmation. Lead times may vary depending on:

– component availability
– supplier schedules
– production queue
– seasonal demand
– quality control procedures

The delivery period begins only once full payment has been received and confirmed.

If a product becomes unavailable after order confirmation, the Customer will be informed without undue delay and any payment received will be refunded within 14 days. In such case, the sales contract is cancelled.


3. Force Majeure

If delivery is delayed due to circumstances beyond our reasonable control, the delivery period will be extended accordingly.

Such circumstances include, but are not limited to:

– strikes or industrial action
– supply chain disruption
– component shortages
– transport disruptions
– natural disasters
– pandemics
– war or geopolitical events
– governmental or regulatory actions
– energy shortages
– cybersecurity incidents affecting logistics

If delivery becomes impossible due to such events, IKUISTA reserves the right to withdraw from the contract. Any payments received will be refunded without undue delay.

IKUISTA shall not be liable for indirect or consequential damages caused by force majeure delays.


4. Payment Condition Before Production

For made-to-order bicycles, production and component reservation begin only after full payment has been received and confirmed.

If payment is delayed, the delivery timeframe is automatically extended accordingly.

IKUISTA is not responsible for delivery delays resulting from late payment.


5. Customer Collection (If Offered)

Where Customer Collection is offered and agreed:

– A collection appointment must be scheduled in advance.
– The bicycle must be collected within 7 days of notification of readiness.

If the Customer fails to collect the product within this period and does not respond to reminder notice, IKUISTA may cancel the contract.

In such case, cancellation may be subject to deduction of direct and reasonable costs incurred, where legally permissible.


6. Transport Damage

The Customer should inspect the package upon delivery.

If visible transport damage is detected:

– Report the damage to the courier immediately.
– Contact IKUISTA at info@ikuista.com without undue delay.
– Provide photographs of the outer packaging, inner packaging, and damaged product.

Failure to report visible damage promptly does not limit statutory consumer rights but may affect our ability to pursue claims against the carrier.

If damage is suspected, the product must not be used.


7. Assembly After Delivery

All IKUISTA bicycles are assembled, adjusted, and quality-checked prior to shipment.

For transport safety, certain components may be partially disassembled, including but not limited to:

– front wheel
– handlebars
– seatpost
– pedals

After delivery, the Customer is responsible for correctly installing these components in accordance with:

– provided instructions
– torque specifications
– online assembly guides

If the Customer lacks sufficient technical competence, professional assembly by a qualified bicycle mechanic is strongly recommended.

IKUISTA is not liable for damage or injury resulting from improper installation, incorrect torque, incompatible components, or failure to perform safety checks.

Statutory liability for defects existing at the time of delivery remains unaffected.


8. Transfer of Risk

In accordance with EU consumer law, risk of loss or damage transfers to the Customer when the product is physically delivered to:

– the Customer, or
– a third party designated by the Customer (other than the carrier).

If the Customer independently arranges a carrier not offered by IKUISTA, risk transfers upon handover of the goods to that carrier.


9. Failed Delivery

If delivery fails due to incorrect or incomplete address information provided by the Customer:

– Additional shipping costs may be charged.
– Re-delivery will occur only after such costs are paid.

If the Customer repeatedly fails to accept delivery, IKUISTA may cancel the order after reasonable notice.

Where legally permitted, direct and reasonable shipping and handling costs may be deducted from any refund.


10. Partial Deliveries

IKUISTA reserves the right to make partial deliveries where reasonable.

Partial delivery does not entitle the Customer to withdraw from the contract unless required by law.


11. Limitation of Liability for Delivery Delays

To the fullest extent permitted by law, IKUISTA shall not be liable for:

– indirect damages
– loss of use
– loss of profits
– missed events or competitions
– personal inconvenience

arising from delivery delays, unless caused by intentional misconduct or gross negligence.

Nothing in this section excludes liability that cannot be excluded under applicable law.
